The Financial Sector Conduct Authority (FSCA), South Africa’s financial watchdog, has published a brief notice stating that bitcoin assets would now be categorized as financial products, allowing them to be regulated.
The FSCA called cryptocurrencies “a digital representation of value” and required that they be governed in the nation as of the publishing date.
The regulator stated that a definition of crypto assets has now been added to the 2002 Financial Advisory and Financial Intermediary Services Act (FAIS), a development that has been expected for some months. Its implementation will result in the first regulation of cryptocurrencies in South Africa.

A financial product, according to the FAIS, is any security, bond, “any money-making instrument,” or instrument that grants rights to securities and instruments. Financial products can lawfully be made available by licensed financial service providers in South Africa.
The FSCA released a draught Declaration of Crypto Assets as a Financial Product under the FAIS Act on November 20, 2020, for public study and discussion, according to a press statement that was issued alongside the announcement.
22 distinct commenters submitted a total of 94 comments, and after they were all examined, the FSCA published the final Declaration in the Government Gazette and online.
A national working committee produced a blueprint for a regulatory framework in June 2021. The National Treasury of South Africa said in February 2022 that it will make cryptocurrencies a financial instrument and strengthen oversight and compliance with related activities.
The new rule does include a number of broad exclusions from section 7(1) of the FAIS Act “for people performing financial services (advice and/or intermediary services) in regard to Crypto Assets.”
In order to “enable transitional arrangements for existing providers of crypto asset activity,” several exemptions were created. Or, to put it another way, “provide financial services in regard to crypto assets without being licensed, providing such person applies for a license under the FAIS Act within the term indicated in the exemption.”
Unlicensed organizations have been given permission to provide services without a license between November 30, 2022, and June 1, 2023, while their application is being considered.
